Positivismo normativo e o debate que importa

Eu argumento que o debate conceitual em torno da tese positivista da separabilidade entre direito e moralidade não tem relevância prática ou teórica, na medida em que, primeiro, as consequências morais benéficas que alguns positivistas julgaram decorrer da adoção da tese da separabilidade podem decorrer plausivelmente da mesma forma de sua rejeição e, segundo, os dados disponíveis para a análise do teórico do direito se coadunam tanto com o conceito positivista de direito quanto com conceitos rivais, até porque a decisão pelos dados que contam já depende da teoria que adotamos. Em outras palavras, eu trato o conceito de direito como um artefato e ofereço algumas evidências de que nada de relevo dependa de como moldaremos exatamente esse artefato. Após ter argumentado nesse sentido, eu concluo o artigo sugerindo que o debate que importa no âmbito da teoria analítica do direito diz respeito ao positivismo normativo como um modelo de decisão prescrito às autoridades.
