Justice as Fairness or as Reciprocity? The Deliberative Turn on John Rawls’ Political Liberalism

This article aims to demonstrate that, following discussions with Jürgen Habermas in 1995 and 1996, John Rawls incorporated a moment of deliberative legitimation into his conception of justice as fairness in the texts Introduction to the Paperback Edition of Political Liberalism (December 1995), The Idea of Public Reason Revisited (1997), and Justice as Fairness: A Restatement (2001). The deliberative turn refers to changes in at least four internal concepts within Political Liberalism (1993): the revision of the idea of public reason, the expansion of the principle of legitimacy, the restriction of the concept of comprehensive doctrines, and the differentiation between stability for the right reasons and stability of reasons. After examining these transformations, I argue that the deliberative turn was of such significance that it would justify a departure from the usual Portuguese translation of fairness.
