Realismo político e positivismo jurídico na teoria de Jeremy Waldron

O objetivo desse artigo é investigar a relação entre realismo político e positivismo jurídico na teoria de Jeremy Waldron. Em ambos os casos, há a recusa de um tipo de fundamentação moral, seja da política, seja do direito. Além de analisar como se dá a fundamentação da política e do direito na obra de Waldron, este artigo pretende também identificar em que medida uma teoria realista e positivista pode manter como elemento central da política e do direito um valor, tal qual o do desacordo razoável, que parece ser indispensável para a teoria de Waldron.
