Moral damage: an analysis of the arguments rated by judges from the perspective of New Rhetoric

The aim of this study was to analyze the arguments rated by judges to form an understanding of the meaning of moral damage - which is equivalent to a legal phenomenon that can be compensated. To achieve this goal, in an exploratory study, was examined the Case no. 0000192-11.2011.5.04.0001 delivered by the Fourth Chamber of the Regional Labor Court of the Fourth Region (Rio Grande do Sul, Brazil) which deals with moral damages. The arguments were sampled and analyzed from the perspective of New Rhetoric of Perelman and Olbrecht-Tyteca.Downloads
