Paths to a discursive analysis of the voice in the defense of the jury: the excess, the lack, the strangeness

Abstract

The article discusses the issue of lack, excess and strangeness, with the discursive materiality of the legal discourse of the defense in a jury trial. The theoretical model that underlies this discussion is the French Discourse Analysis. In the chosen legal discourse there was a very articulate argument in an attempt to make the discourse transparent and objective. We also noticed two things that stand in the argument: the imaginary formations that try to predict who the caller is and the forgetfulness number one and number two, which provide the illusion that the subject articulates its creative and unique way of speech, and the great goal of the discursive subject of defense is to destroy the arguments of his opponent. From these findings we started our analysis, and Ernst’s theoretical contribution, which presents possible paths for the discourse analyst, was essential considering the choice of the corpus.
