Freedom of expression, hate speech and social irrationality: an analysis based on habermasian democratic theory

Abstract

This article aims to analyze the pertinence of still defending, within the framework of normative theories of democracy, criteria of rationality and argumentation and reasoned justification for public debates so that the border between freedom of expression and hate speech or discrimination. This analysis will be based on the Habermasian discursive theory of law and democracy, which has supported the importance of criteria of rationality in moral, political and legal issues.
