Jurisprudence and the system of sources in Brazil: a historical-juridical view

This paper intends to capture the jurisprudence theme (as a legal manifestation) from the general problem of formal sources, taking into account the historical and legal assumptions concerning it – that is, having a glimpse at the legal object in its diachronic necessity. This way, it searches for the role of the theme in three distinct moments of Brazilian history: during the “legal pre-modernity” (until the 19th Century), during the “legal modernity” (between the 19th and the 20th Centuries), and, finally, during the “post-modernity” (from the late 20th Century on).Downloads
