O papel da deliberação democrática no plano constitucional de Condorcet

Este trabalho pretende analisar a dupla função desempenhada pela deliberação no Projeto de Constituição de Condorcet apresentado à Convenção Nacional em 1793. A deliberação, pautada num conjunto de normas e procedimentos, tem um papel constitutivo, uma vez que é responsável pela aprovação de leis e capaz de conduzir os rumos da política nacional, mas também fiscalizador, pois é por meio dela que os cidadãos podem revogar leis e demais medidas administrativas ou afastar a representação escolhida. Dessa forma, a proposta do autor é capaz de estabelecer uma estreita ligação entre representação e participação, entre legalidade e a legitimidade e, por fim, entre a ordem jurídica e os processos de decisão política.
