Policontexturality and reflective environmental law

This work presents a description of the coupling between Law and Politics in Contemporary Society. Under the expression “Polycontexturality”, as a criterium to investigate the sense fragmentarion in post modernity, thereis a possible and interesting analysis of the Transnational Legal Pluralism. Following the “irritations” caused by ecological risks in our Society is the “Environmental State” which means a new function to the State, as a political organization with the scope to maintain itself as a privileged social actor. Thus, the new rights are the place where the Polycontextural Observation and the State organizational operation are redefining the complexity over the relations between Law and Politics, under the sight of Reflexive Right.Downloads
