This historiographic paper aims at analyzing the Portuguese experience considering the transition of common law, which changed itself from the XVth century, in a purely secondary law category, when compared to the real legislation and common law that controlled more and more extensively social life. Concerning justice management, it was the same process, from XVth century, when a continuous intervention of real justice (erudite) would gradually have substituted the juridical autonomy of Councils as well as the landlords’ one (peasants).Downloads
