Abstract

This paper aims at analyzing basic aspects from the new Spanish arbitration law (60/2003 Law), that established new juridical system about the institute, proposing real incentives to individuals and enterprises so that they could choose this way of solving con?icts. The law adopted the monist paradigm and through it, the internal judgment as well as the external one (international) have almost the same regulation, since principles would be few, but very justi?ed where international arbitration requires a distinct regulation from the national one.
