Abstract

This paper presents the theoretical postulates of Restorative Justice in its original matrix, from an objective alternative sociability and this process included an autochthonous legality and emancipatory. Making as a complex process of social democratic and dialogical construction, facing the present and future and also to rescue the social ties and solidarity, guided by the principles of co-production and contact – inter-relationship and inter-dependence. Thus, when analyzing the legal, factual and epistemological fits the need of eruption dynamics of sociality and alternative dispute resolution. Based on the theoretical assumption that still is disregard of the state, it ceases to be the central organ of the social structure and regulatory framework, to become, at best, contributing to a dynamic and culturally constructed social emancipation and sociability
