This article focuses on Bachelard’s epistemology. The study aims to investigate the notion of epistemological obstacle from the thought of Bachelard, and the adoption of this conception by Miaille, in order to find out the possibility of its use for the production of scientific legal knowledge. Thus, in the first place, we investigated Bachelard critics to rationalism and empirism, particularly the seventeenth century. From this, we analyzed the concept of epistemological obstacles to the progress of science. Finally, we investigate the possibility of overcoming the epistemological obstacles to progress in the Science of Law. The result is that, beyond the Bachelard’s critics, in a negative sense, the incorporation of obstacles in the thought of Miaille allow us to overcome this sense and adopt a positive review of the construction of a definition for scientific research of law.Downloads
