Abstract

The present essay intends to analyze the concept of public policies, starting from their beginning, in the heart of the administrative revolution worked at the traditional public administration model, since the early 20th century, emphasizing the postulates of legality, legitimacy and policy making degrees, in order to get enough information in order to explain its way of being and its characteristics. The article tries to promote an approach into the public administration, pointing its focus on the new institute of policies – if we are allowed to call it this way –, with the purpose of obtaining the necessary researches in various different areas of Constitutional Law and Administrative Law.

Pós-doutorando na Fordham University Law School (New York – EUA). Doutor em Direito e Evolução Social pela UNESA. Mestre em Direito e Economia pela UNIG. Especialista em Direito Público e Privado pela EMERJ. Especialista em Direito Empresarial e Tributário pela FGV. Especialista em Docência do Ensino Superior pela UFRJ. Especialista em Coordenação Pedagógica e Técnica de Ensino pelo CEP. Graduado em Direito pela UERJ. Professor na CED-UNOESC, EMERJ, FEMPERJ e FESUDEPERJ.
