The Prosecution Service as Superego of Society: institutional design and legitimacy in judicial and extrajudicial proceedings

This article analyzes the expansion of the juspolitical function carried by Prosecutors under the theoretical framework of Ingeborg Maus. It uses hypothetical-deductive reasoning, drawing on data from primary and secondary nature, concluding that, to avoid arbitrariness restrictions of popular sovereignty, it is indispensable that the Prosecution Service adopts a new institutional design, enhancing its performance by focusing on the efficient exercise of the role of superego of society.Downloads
