Abstract

The boundaries of a school of thought in legal theory are often a contested topic in metatheoretical works on law. This is true of legal realism, even when considering the writings of authors who identify with realism. In this context, this paper aims to illustrate this issue through an examination of Hans Kelsen's Pure Theory of Law. The question of whether Kelsen's theory is close to legal realism is developed dialectically through a qualitative approach, which contrasts the views of two thinkers rooted in the tradition of legal realism: Pierluigi Chiassoni and Brian Leiter. After a critical examination of Leiter’s perspective on the transcendental idealism of the Pure Theory, which he sees as preventing it from being considered realist, this article concludes that Chiassoni's position, which argues for an affinity between Kelsen's theory and legal realism, is more accurate.

Especialista em Docência do Ensino Superior e Educação em Direitos Humanos. Membro da Associação Brasileira de Filosofia do Direito e Sociologia do Direito (ABRAFI).
