Social function and collective guardianship: A contribution from roman law to a new paradigm

It is provided a theoretical effort in order to rescue effectiveness of Social Role concept from Roman Rights. The first step is to review the classification of goods as public and private, defended by the codes, also to give back to Society a juridical tutor of the collective or social goods which are fundamental. The state-owned voluntarism will, so, lose the public monopoly, disconstituting the trap of getting private goods from everyone, prepared by coding paradigm.Downloads
