The legal nature of the toll gate

Abstract

This essay aims identify the juridical nature of the road tolls, under the Brazilian Constitution provisions. We will start with a brief history of the toll roads in Brazil. In a second moment, we will study the toll roads under the Brazilian Constitution provisions. Later, we will see the jurisprudence and courts opinion to, eventually, conclude that the toll roads will be taxes, or not, depending on the circumstances.
