Public Ministry and accusatory proccess: For a constitutional ethics in the penal proccess

The present article aims at demonstrating how the accusatory penal process is the one which better embodies constitutional principles and guarantees, being, therefore, duty of the Public Ministry, whose objective is to defend the democratic regime and the rule of law, to implement a new practice in penal process law in which this model may be privileged, in spite of limitations imposed by Brazilian penal process law, which still reproduces much of the inquisitional and authoritarian model.Downloads
