Some reflections on the communitarist paradigm incorporation in the Constitution of 1988

It is conferred to the 1988 Constitution a communitarian influence that proclaims the citizen potential participation. By sparing values and ordinary community goals, politics becomes a field for reflexion, for increased value of Social Justice and the values and principles of the community, now constitutionalized. Moreover, the Constitutional Justice performed by the Federal Supreme Court is increased in a process known as the enlargement of the “interpreter’s community”. Therefore, the focus of this article is to doubt the influence of the communitarian pattern on the constitutional text through out deliberation about its relation with details of Brazilian’s society and the process of judicialization of politics.Downloads
