Abstract

This paper aims at to analyze the problem of the delimitation of the right in agreement with the approaches of the Independent Legal Pluralism The analysis of this delimitation was made through four dimensions of borders, which are: (1) the definition of the right when there is diversity in their expressions; (2) the definition of the social groups able to generate right; (3) the separation between the right forms and the other forms of social control; and (4) the borders among the different rights of the different social groups. For this analysis, it was made a theoretical research in the authors’ of the Legal Pluralism, classic and recent main works.

Antonio Carlos Wolkmer, UFSC

"Formado em Direito pela Universidade do Vale do Rio dos Sinos (1977), mestre em Ciência Política pela Universidade Federal do Rio Grande do Sul (1983) e doutor em Direito pela Universidade Federal de Santa Catarina (1992). Professor titular nos cursos de graduação e pós-graduação em Direito da Universidade Federal de Santa Catarina, pesquisador do CNPq. Atualmente é Coordenador do Programa de Pós-Graduação em Direito da UFSC. Professor convidado em diversas universidades do exterior: Espanha, México, Perú, Colômbia, Argentina e Porto Rico. Tem experiência na área de Direito, com ênfase em Teoria do Direito, atuando principalmente nos seguintes temas: sociologia jurídica, pluralismo jurídico, historia do direito, filosofia do direito e direitos humanos.
