How to untie the knots of brazilian constitutionalism

The study shows some shortcomings of the actual constitutional Brazilian model. It analyzes both their philosophical basics as some inconsistencies in its application by the judges. From this analysis, it attempts to present a complementary model that combine aspects of legal realism and other branches of science, understanding the law as a moral and political practice of resolving conflicts and trying to describe it with more accuracy to prescribe optimal standards of democratic control of power.Downloads
