Abstract

Adopting the conception that the obligation is a process entered into a complex structure of economic relationships, developed through several combinations of factual and contractual possibilities, which ma not be protected by Law (e. g. promissory contract of purchase and sale without register in notary's office), we will figure out that the relativization between Property Law and Law of Obligations is something essential to the legal comprehension about social function of property and possession in Brazilian Law. This social function gives autonomy to the possession and deals the property such as contribute, enabling both material freedom of human being and material realization of fundamental rights, specially the housing rights.
