The creativity of interpretation: imagination in legal interpretative practices

Abstract

The objective of this article is to explore a possible place for imagination within the interpretative practices of the legal actors. The research takes as its starting point the theoretical approach of Ronald Dworkin the interpretative practices of literary theory and law. Through a literature review of Dworkin´s position and of other researchers’ approach, this article argues that imagination is present when, as it develops a holistic interpretation of the legal system, the legal actor has as its horizon a future society based on the basic principles of that system.
