The crisis of international law and the emergency of the international law of recognition: in a critical decolonial perspective?

The present work aims to investigate the emergence of an International Law of Recognition during a crisis of international law itself, often intended to be an instrument for the development of political imperialism today transmuted into financial imperialism. The question is whether the International Law of Recognition, which appears as a new branch of international law under construction, especially after the Cold War, can be seen in a decolonial and, therefore, emancipatory perspective in the face of the reality of the third world. To this end, the historical-dialectic method and the bibliographic and documentary research technique were used. It was understood that the international law of recognition, by not aiming at a structural change, but rather, acting within the limits of what is possible using the evolution of international rules, plays an important role in the construction of global justice, however, it must remain attentive to criticisms of the decolonial perspective, which advocates a structural change in the international order itself.
