The collective dimensions of privacy and personal data: commons with restricted use

This article aims to highlight the existence of collective dimensions in the field of privacy and data protection, which are practically disregarded in the current legal discipline, based on the notion of informational self-determination. Due to the coexistence of this aspect with those of an individual and very personal nature, it is argued that there are multiple ownerships of these fundamental rights. In order to guide the construction of appropriate rules for the protection of transindividual interests, the criticisms of the patrimonialist logic that permeates the current legal framework are analyzed and it is proposed that privacy and data protection should not be classified on the basis of traditional categories of law, such as legal good, subjective right and legal situation. Finally, they should be categorized as common, whose use and availability should be very restricted, and the construction of a discipline should have broad popular participation.
