Abstract

The purpose of this study is to minutely analyze the legitimacy provided to the
Public Defender´s office by law 11.448/2007, for filing Public Civil Actions, in the light of a constitutional doctrine. The reason for choosing such topic is the importance of this institution for a greater access to justice and in the guarantee of The Democratic State of Law. The article also discusses the legal role of oth-er institutions, such as the Public Prosecutor´s office, to file civil public actions and to build a more just legal system.  This article has profited from analyses from other areas of human knowledge, such as Constitutional Law, Civil and Criminal Procedure Law and Legal Sociology.
