Delineation of indigenous lands in the brazilian Supreme Federal Court and the decolonisation of the concept of possession

Abstract

One of the most impactful cases for decolonization efforts and transformative changes in the Brazilian constitutional structure can be observed in the Constitutional Court’s rulings on the protection of Indigenous lands and the debate over the existence of a marco temporal (time frame) capable of defining the period that would justify the displacement of traditional peoples and the alienation of their lands for colonization purposes. This research aims, based on the principles and interpretations established by the Federal Supreme Court, to analyze the break with the historical tradition of occupation and regulation of Indigenous lands, beginning by distinguishing the notion of Indigenous land possession from the concept of possession derived from the Germanic-Roman legal tradition. In this sense, it highlights the use of argumentative models grounded in theoretical frameworks and judicial decisions primarily developed in Brazil, thus breaking with the tradition of relying on foreign citations and precedents, and demonstrating the need to limit, through transconstitutionalism, a new instrument of hegemonic domination. According to the understanding of the Supreme Court, the lands occupied by traditional peoples are the permanent possession of these communities, and they hold the right to the usufruct of the resources of the soil, rivers, and lakes existing therein. This represents the recognition of a form of legal pluralism that is typically decolonial and endemic.

Márcio Ricardo Staffen, UNIVALI

Doctor in Public Law from the Università degli Studi di Perugia (Italy), with a PhD and a Master’s in Legal Science and a Law Degree from UNIVALI. Completed a Postdoctoral Fellowship at the Università degli Studi di Perugia (CAPES/PDE). Permanent Professor in the Graduate Programs in Legal Science (UNIVALI, CAPES 6) and in Law (Atitus Educação), and former Program Coordinator (2014–2018). Visiting Professor in Perugia and Visiting Researcher at the Max Planck Institute for Comparative Public Law and International Law (Heidelberg). Recipient of a Doctor Honoris Causa degree and Honorary Professor titles in Peru. Attorney (OAB/SC), Guest Researcher at Transparency International, and member of academic and human rights institutions in Brazil, Mexico, and Peru.

Enrique Prieto-Rios, UDR

Associate Professor of Law at Universidad del Rosario, specializing in public international law, international economic law, and human rights. He holds a PhD in Law from Birkbeck, University of London, an MA in International Law, and an Honours Law Degree from Universidad del Rosario. His work combines research, teaching, and consultancy for governments and international organizations, with expertise in business and human rights and international investment law. He has served as Visiting Fellow at the Max Planck Institute and other international institutions, and has an extensive record of publications and research leadership. Fluent in English and Spanish, he actively contributes to academic, policy, and international cooperation initiatives.

Luana Abrahao Francisco, UNIVALI

She is a Master’s in Legal Science at the University of Vale do Itajaí (UNIVALI, CAPES 6), in a dual-degree program with the Università degli Studi di Perugia (Italy). She holds a Law Degree from UNIVALI, where she received the Student Merit Award for outstanding academic performance, scientific engagement, and ethical conduct. She serves on the editorial boards of Novos Estudos Jurídicos (QUALIS A1) and Direito e Política (QUALIS A2), and is a member of the CNPq-certified Research Group on Law and Transnationality. A licensed attorney (OAB 69193) and certified insurance broker, she is also a partner at Grantee Corretora de Seguros Ltda.
