Abstract

The present article develops a theoretical analysis of the contribution of Hans Kelsen in the field of Juridical Hermeneutics, emphasizing rupture and continuity with the traditional doctrine of interpretation. It also seeks to inquire about the internal logical coherence between the Kelsenian Theory of Interpretation and the epistemological suppositions of his Pure Theory of Law. Finally, it intends to identify theoretical conditions for critical hermeneutics.

Isaac Reis, UFPE

Possui graduação em Direito pela Universidade Federal da Bahia (1999) e mestrado em Direito pela Universidade Federal de Santa Catarina (2003), sob a orientação do Prof. Dr. Antonio Carlos Wolkmer. Foi Professor e Coordenador de Curso na Unidade de Ensino Superior Dom Bosco, em São Luís/MA/Brasil, de 2003 a 2010. Atualmente, é doutorando em Direito na Universidade Federal de Pernambuco (UFPE), sob a orientação do Prof. Dr. João Maurício L. Adeodato. Tem experiência na área de Direito, com ênfase em Filosofia e Teoria do Direito, atuando principalmente nos seguintes temas: Ensino Jurídico, Metodologia da Pesquisa, Epistemologia Jurídica e Hermenêutica Constitucional.
