Abstract

The present article objectifies to focus in a heterodox and vertical hermeneutic posture, based on the normative power of the Federal Constitution, as a possible way to solving the existent tension among the constitutional principles, providing conditions to the Fundamental Rights effectiveness. The challenge is to overcome the decisionism and arbitrariness, managing the legal paradoxes of modernity in the proper way.
