Oliveira Vianna and the New State's corporative origin: Antiliberal State, social rights and political representation

The jurist and sociologist Francisco José de Oliveira Vianna (1883-1951) advocated political-economic model for the Brazilian modernization between 1930 and 1940. This model was characterized by the strong influence of fascist corporatism matrix. As a result of direct institutional embodiment of his model, the New State (1937-1945) created not only the Labour Court, but incorporated the perspective of an antiliberal and antiformalist law. This represented an acknowledgment of the normative character not only of the judicial decisions, but of the very activity of the executive branch. This paper aims to clarify the foundations of the sociological interpretation of the author about the Brazilian reality, the changing process of the perspective and structure of law and the constitutional amendments and policies generated by the absorption of yours corporative ideas.Downloads
