Right to reproductive health as justice and care

This article analyzed Minister Rosa Weber's vote in the Claim of Non-Compliance with Fundamental Precept 442 on the criminalization of abortion in the first twelve weeks. It was verified whether the decision is in line with the demands of justice and care, through a relational feminist perspective. Firstly, it was studied the interactions between the ethics of justice and care in the field of Law and legal decidability. Then, it was verified whether both values are present in the judgment. The approach method used was the deductive one, with bibliographic and documentary analysis techniques, using texts by Robin West as a theoretical framework. It was concluded that the such vote is in line with the demands of justice and care, by proposing a system of reproductive social justice, instead of limiting itself to inferring a right to choose with a negative dimension.
